A 35-year-old truck driver injured in a Knoxville tractor trailer accident secured a $300,000 settlement to cover extensive medical expenses and ongoing rehabilitation.
Plaintiff, a 35 year old male at the time of the subject accident, was sleeping on the top bunk of his tractor trailer, while parked at a truck stop located in Knoxville, TN; during which time, Defendant, who was attempting to make a right turn around Plaintiff’s tractor trailer with her tractor trailer, caused her own trailer to collide with the front-end of Plaintiff’s truck, causing Plaintiff to fall onto the hard floor of his tractor in his sleep.
The intensity of the impact has caused Plaintiff thousands of dollars in personal damages. It is manifested that the Defendant took no attention to her speed or the traffic around her, thereby precipitating a collision with Plaintiff’s vehicle. The Defendant was operating the vehicle in such a reckless manner, in violation of the following Tennessee Vehicle Codes: §55-8-142 – “(a) No person shall turn a vehicle at an intersection unless the vehicle is in proper position upon the roadway as required in §55-8-140, or turn a vehicle to enter a private road or driveway, or otherwise turn a vehicle from a direct course or move right or left upon a roadway, unless and until this movement can be made with reasonable safety.” §55-10-205 – “(a) A person who drives any vehicle in willful or wanton disregard for the safety of persons or property commits reckless driving.” §15-301 – “(a) It shall me unlawful for any person to operate or drive a motor vehicle upon any highway or street at a rate of speed in excess of 30 mph, except where official signs have been posted indicating other speed limits, in which cases the posted speed limit shall apply.”
As a result of his truck accident, Plaintiff suffered injuries to his head (with a concussion), neck, upper back, middle back, lower back, bilateral knee, right arm, right thumb, as well as severe headaches. Plaintiff’s injuries were significant enough to incur $88,000 in medical expenses. Plaintiff sustained a mild traumatic brain injury, to where he now has ongoing sporadic headaches, for which he will require intermittent neurological consultations and neurocognitive rehabilitation.
Defendants disputed Plaintiff’s claims for injuries and damages. Defendants also disputed the reasonableness and necessity of Plaintiff’s medical treatment. However, through the testimony of expert doctors, it was determined that Plaintiff’s injuries and treatment were reasonable and necessary, considering the severity of the impact. Messrs. Khakshooy and Agarwal were able to recover $300,000 for Plaintiff.
