Plaintiff, a 24 year old paraplegic male at the time of the subject accident, was using Defendant’s medical transportation services. When Plaintiff was assisted onto Defendant’s medical transportation van, Defendant’s driver failed to fasten Plaintiff’s wheelchair in a proper manner. Upon completion of his transport located in Palmdale, CA; Defendant’s driver opened the door to the medical transport van, and Plaintiff, along with his wheelchair, fell from the medical transportation van onto the hard ground.
The intensity of the impact to the hard ground has caused Plaintiff thousands of dollars in personal damages. It is manifested that the Defendant failed to complete his work duties in a safe and reasonable manner, causing injuries to Plaintiff’s person. The Defendant was in violation of the following California Code of Regulations - Cal. Code Regs. Tit 22, section 51231.2, Wheelchair Van Requirements:
As a result of his automobile accident, Plaintiff suffered injuries to his neck, upper back, lower back (with severe bruising), and bilateral shoulder. Plaintiff’s injuries were significant enough to incur $3,500 in medical expenses. Plaintiff required several months of lumbar spine physical therapy treatment, and he continues to undergo sporadic lumbar spine pain, for which he will require intermittent chiropractic and physical therapy treatment in the future.
Defendant disputed Plaintiff’s claims for injuries and damages. Defendant also disputed the reasonableness and necessity of Plaintiff’s medical treatment. However, through the testimony of expert doctors, it was determined that Plaintiff’s injuries and treatment were reasonable and necessary, considering the severity of the impact. Messrs. Khakshooy and Agarwal were able to recover $285,000 for Plaintiff.
