Two women injured in a Culver City car accident secured a $920,000 settlement for severe injuries, including spinal and brain trauma. One plaintiff tragically passed away in 2021.
Plaintiff-1, a 35 year old female at the time of the subject accident, along with her 33 year old female passenger, Plaintiff-2, were traveling on a public street with the right-of-way, located in Culver City, CA; during which time, Defendant, who at the time was not paying attention to the traffic signs ahead of him, entered the intersection, causing both vehicles to collide.
The intensity of the impact has caused Plaintiffs thousands of dollars in personal damages. It is manifested that the Defendant took no attention to the traffic signs ahead of him, thereby precipitating a collision with Plaintiffs’ vehicle. The Defendant was operating the vehicle in such a reckless manner, in violation of the following California Vehicle Codes: 22450 – (a) “The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection shall stop at a limit line, if marked, otherwise before entering the crosswalk on the near side of the intersection. If there is no limit line or crosswalk, the driver shall stop at the entrance to the intersecting roadway.” 22350 – “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” 23103 – “(a). A person who drives a vehicle upon a highway in a willful or wanton disregard for the safety of persons or property is guilty of reckless driving.”
As a result of his automobile accident, Plaintiff-1 suffered injuries to her head (with a concussion), neck, chest, lower back, bilateral wrist, as well as headaches. Plaintiff-1’s injuries were significant enough to incur $172,000 in medical expenses. Plaintiff-1 required lumbar spinal pain relieving injections and neurological consultations for a mild traumatic brain injury, to where she now has ongoing sporadic lumbar spine pain and head pain with neurocognitive deficits, for which she will require intermittent chiropractic and physical therapy treatment in the future, along with neurocognitive rehabilitation.
As a result of her automobile accident, Plaintiff-2 suffered injuries to her head (with a concussion), neck, lower back, right hand, and right wrist, along with a right finger laceration and headaches. Plaintiff-2’s injuries were significant enough to incur $141,000 in medical expenses. Plaintiff-2 required cervical and lumbar spinal pain relieving injections, and neurological consultations for a traumatic brain injury. Unfortunately, Plaintiff-2 passed away in 2021.
Defendants disputed Plaintiffs’ claims for injuries and damages. Defendants also disputed the reasonableness and necessity of Plaintiffs’ medical treatment. However, through the testimony of expert doctors, it was determined that Plaintiffs’ injuries and treatment were reasonable and necessary, considering the severity of the impact. Messrs. Khakshooy and Agarwal were able to recover a global settlement of $920,000 for Plaintiffs.
