California Attorney Group secured $285,000 for a 53-year-old truck driver injured in a tractor-trailer collision at an Ohio truck stop. The crash caused multiple injuries requiring extensive medical care.
Plaintiff, a 53 year old male at the time of the subject accident, was sleeping on the top bunk of his tractor trailer, while parked at a truck stop located in Hubbard, OH; during which time, Defendant, who was not paying attention to Plaintiff’s parked tractor trailer behind him, reversed his tractor trailer, and severely collided with the front-end of Plaintiff’s tractor trailer, causing Plaintiff to fall down onto the floor of his tractor in his sleep.
The intensity of the impact has caused Plaintiff thousands of dollars in personal damages. It is manifested that the Defendant took no attention to her speed or the traffic around her, thereby precipitating a collision with Plaintiff’s vehicle. The Defendant was operating the vehicle in such a reckless manner, in violation of the following Ohio Vehicle Codes: 4511.38 – “(a) No person shall start a vehicle, streetcar, or trackless trolley which is stopped, standing, or parked until such movement can be made with reasonable safety. Before backing, operators of a vehicle, streetcars, or trackless trolleys shall give ample warning, and while backing they shall exercise vigilance not to injure person or property on the street or highway.” 4511.20 – “(a) No person shall operate a vehicle, trackless trolley, or streetcar on any street or highway in willful or wanton disregard of the safety of persons or property.”
As a result of his truck accident, Plaintiff suffered injuries to his neck, upper back, lower back, bilateral knee, left shoulder and left arm. Plaintiff’s injuries were significant enough to incur $33,000 in medical expenses. Plaintiff required pain relieving spinal injections as well as bilateral knee injections, to where he now has ongoing sporadic lumbar spine pain and bilateral knee pain, for which he will require intermittent chiropractic and physical therapy treatment in the future.
Defendants disputed Plaintiff’s claims for injuries and damages. Defendants also disputed the reasonableness and necessity of Plaintiff’s medical treatment. However, through the testimony of expert doctors, it was determined that Plaintiff’s injuries and treatment were reasonable and necessary, considering the severity of the impact. Messrs. Khakshooy and Agarwal were able to recover $285,000 for Plaintiff.
